What is Probate

Probate is the court-supervised process of administering an estate. In British Columbia, probate involves proving in court that a will is valid, confirming an executor or appointing administrator to manage the estate’s assets and liabilities, collecting the deceased person’s assets, paying any creditors or taxes owed (if necessary), and distributing the remaining assets to the beneficiaries named in the will. The executor/administrator is responsible for ensuring that all of these steps are followed, as well as filing court documents and providing notice to parties who may be interested in the estate’s proceedings. Probate can sometimes take several months or years to complete, depending on its complexity.

what is a power of attorney?

A Power of Attorney (POA) is a legal document that allows one person to give another person the authority to act on their behalf in matters such as financial or legal decisions. The individual giving the authority is called the “donor”, and the individual receiving the authority is called the “attorney-in-fact”. The attorney-in-fact is legally obligated to act in accordance with instructions from the donor, or in their best interests if none are given. Powers of Attorney can be either general, granting broad authority over all matters specified by the principal; enduring, which will allow your attorney-in-fact to continue making decisions on your behalf even if you become mentally incapable;.or limited, granting only specific powers in a single area of decision-making. A Power of Attorney can be revoked at any time by the principal as long as they are mentally competent to do so.
